A code change in Massachusetts and a mass-timber prototype in Portland. The mid-rise walk-up — extinct since the 1940s — is suddenly viable again.
The American mid-rise walk-up — five to eight stories, no elevator, single-stair core — has been functionally illegal in most jurisdictions since 1942.
The prohibition was not a single decision. It was a slow accretion of code requirements adopted across the 1940s and 1950s — two-stair egress on any building over three stories, elevator service on any building over three stories with residential units above the ground floor, sprinkler requirements that effectively required full mechanical systems beyond what walk-up construction could support. The cumulative effect was that the residential typology that had built the country’s pre-war urban housing stock became uneconomical to construct under modern code.
That regulatory consensus, after almost ninety years, is starting to crack.
The Massachusetts code change
The Commonwealth of Massachusetts adopted a stretch-code amendment in late 2025 that re-permits single-stair residential construction in buildings up to eight stories, subject to four conditions: sprinkler protection throughout, the use of fire-resistant construction in the structural framing (specifically, encapsulated mass-timber or non-combustible structure), increased corridor and stair-shaft fire-rating, and a per-unit floor-area maximum that limits the building to small-format dwelling units. The amendment is opt-in for individual municipalities and has been adopted by Boston, Cambridge, and Somerville.
The technical case for the amendment, made over the prior three years by a coalition of the state’s housing-policy community, the structural-engineering community, and the architectural community, was that the single-stair prohibition in modern code is more conservative than necessary given the fire-protection systems now standard in mid-rise construction. The empirical comparison the coalition cited is the European mid-rise residential stock, which has been built to a single-stair standard with similar fire-protection requirements and has operated with fire-safety outcomes comparable to or better than US mid-rise residential.
The Portland prototype
The Portland project, a six-story all-CLT residential prototype on a Northwest Portland infill site, was permitted under Oregon’s own single-stair amendment, which was adopted in 2024 and is broader in scope than the Massachusetts version. The Portland project has been the first US execution of the typology at scale; the building has been in occupancy for approximately eight months.
The construction cost, on the prototype, came in at approximately seventy-eight percent of the cost of a comparable conventional mid-rise residential building on the same site. The cost savings are decomposable into three pieces: the elimination of the second stair (and the associated structural and mechanical complications), the reduction in non-rentable common-area floor space, and the mass-timber structural cost premium offset by faster construction. The cost saving is meaningful at small scale. It is substantial at scale.
The post-occupancy data on the building — eight months in — has been favorable. Fire-protection systems have not been tested by a fire event, and will not, ideally, be tested in that way. The thermal performance of the mass-timber envelope has exceeded the projections in the original energy model. The acoustic isolation between units has been adequate but not exceptional. The residents’ satisfaction surveys have been positive.
Why this matters for residential development
The economic case for the typology is straightforward. The American urban housing market needs additional units in the mid-rise range — the segment between single-family and high-rise — that the modern building code has effectively made too expensive to construct profitably at market-rate rents. The single-stair typology, executed with mass-timber or non-combustible framing, addresses the cost problem at the structural level. It does not solve the full affordability problem; it does, on a project-by-project basis, expand the set of urban infill sites where mid-rise residential construction is economically viable.
The trade-press conversation has been slow to engage with the typology because the regulatory pathway has been slow. The Massachusetts amendment is the second state-level regulatory acceptance, and the trade press has begun, in the last six weeks, to cover the typology more seriously.
Where this is going next
Three additional states are working through their own versions of the regulatory amendment. The New York City Department of Buildings has been studying the typology for two years and has, in its most recent public-facing communication on the subject, signaled that it is reviewing whether a similar amendment could be adopted under the city’s home-rule construction-code authority. The Seattle and Vancouver markets, both of which have substantial mass-timber capacity and high-density residential demand, are watching the regulatory developments closely.
The next eighteen months will likely see five to eight additional municipal-level adoptions of the typology, with a corresponding pipeline of approximately twenty to forty project executions across those markets. The economics will be tested at scale. The fire-safety outcomes will be observed. The post-occupancy performance will be measured.
The honest framing
The mid-rise walk-up is not coming back as the dominant urban residential typology. The high-rise elevator building, the low-rise single-family neighborhood, and the conventional five-over-one apartment block will continue to be the building blocks of the American urban housing stock.
What is coming back is an option that did not exist in the development community’s toolkit for ninety years. The option is structurally and economically meaningful. It will not transform the housing market on its own. It will, on the margin, change which urban infill sites can be developed profitably at the rents the market is willing to support.
That is, in a sector that has not had many meaningful new tools in decades, a development worth paying attention to.
